Welcome to Pixel Portraits. These Terms of Service ("Terms") govern your access to and use of our website located at pixelportraits.shop (the "Site") and your purchase of products from Pixel Portraits ("we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or purchase from us.

1. Acceptance of Terms

By using our Site, creating an account, or completing a purchase, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction), have the legal capacity to enter into a binding contract, and agree to these Terms in full. These Terms constitute a legally binding agreement between you and Pixel Portraits.

2. Products and Orders

We reserve the right to limit the quantities of any products we offer, discontinue any product at any time, and refuse service to anyone for any reason at our sole discretion. Product descriptions, images, and pricing are subject to change without notice. We make reasonable efforts to display our products accurately, but we do not guarantee that colors, textures, or other attributes displayed on your device are exact representations of the physical product.

Once an order is submitted and payment is processed, it is considered final. We do not accept order cancellations, modifications, or additions after an order has been placed, except at our sole discretion.

3. Pricing and Payment

All prices are listed in US Dollars (USD) unless otherwise stated. We reserve the right to change prices at any time without prior notice. Payment must be made in full at the time of purchase. We accept payment via the methods available at checkout. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge the full order amount to that method.

In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price and notify you accordingly.

4. Shipping and Delivery

We will make reasonable efforts to ship orders within the estimated timeframe displayed at checkout. However, shipping and delivery dates are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or other factors beyond our control. Risk of loss and title for products pass to you upon delivery to the carrier.

You are responsible for providing an accurate and complete shipping address. We are not liable for orders lost, stolen, or undelivered due to incorrect address information provided by you.

5. No Refund and No Return Policy

All sales are final. We do not accept returns, exchanges, or issue refunds under any circumstances, except as expressly provided in our No Refund & No Return Policy, which is incorporated into these Terms by reference. By completing a purchase, you acknowledge and agree to our No Refund & No Return Policy. The only exception is for items that arrive damaged, defective, or materially different from what was ordered, subject to the conditions outlined in our No Refund & No Return Policy.

6. Custom and Personalized Products

Many of our products are custom-made or personalized based on specifications you provide. You are solely responsible for ensuring the accuracy of any information, artwork, text, or specifications submitted with your order. We are not responsible for errors in orders resulting from incorrect information provided by you. Custom and personalized products are non-refundable and non-returnable under all circumstances.

7. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, product designs, and software, is the property of Pixel Portraits or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Site without our express prior written permission.

By submitting any content, images, or artwork to us for use in a custom order, you represent and warrant that you own or have the necessary rights and permissions to use such content, and you grant us a limited license to use that content solely for the purpose of fulfilling your order.

8. User Conduct

You agree not to use the Site or our services for any unlawful purpose or in any way that violates these Terms. Prohibited conduct includes, but is not limited to: submitting false or misleading information; using the Site to infringe on third-party intellectual property rights; attempting to gain unauthorized access to our systems; engaging in fraudulent transactions or chargebacks; and interfering with the proper functioning of the Site.

9. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PIXEL PORTRAITS, ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pixel Portraits and its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of the Site, your purchase of products, or your submission of inaccurate order information.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state in which Pixel Portraits is registered, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the applicable jurisdiction, and conducted in English. You waive any right to a jury trial or to participate in a class action lawsuit.

13. Chargebacks and Payment Disputes

By placing an order, you agree that initiating a chargeback or payment dispute for any reason other than unauthorized use of your payment method is a breach of these Terms. We reserve the right to dispute any such chargeback, report the dispute to credit agencies, and pursue all available legal remedies including recovery of fees, costs, and damages.

14. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described in our Privacy Policy.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site or placement of orders after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our No Refund & No Return Policy and Privacy Policy, constitute the entire agreement between you and Pixel Portraits with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written.
